
In addition to mandatory license suspensions of Massachusetts Junior Operators Licenses (JOL) for speeding and other violations, there are harsh penalties for alcohol related violations such as DWI & breathalyzer refsuals.
If you are under 21 years old, a breathalyzer reading of .02 or greater or a breathalyzer refusal will result in a 180 day license suspension.
If you are under 18 years of age at the time of the arrest, your license will be suspended for 1 year.
The Massachusetts RMV imposes these suspensions in addition to any penalty, license suspension or revocation imposed by the court.
If you have not been previously arrested for or charged DWI, OUI, drunk driving, or a related violation you may be eligible to participate in a youth alcohol program If you are under 21 but over 18 years old, upon entry into this youth alcohol program, the RMV may waive the above-described license suspension. If you are under 18 years of age at the time of the violation, the youth alcohol program may reduce your 1 year license suspension to 180 days. Contact an attorney to discuss this option.
If a person under the age of 21 fails to successfully complete the youth alcohol program, the Massachusetts Registry will immediately suspend the person’s drivers license for 180 days for those over 21 years of age at the time of the violation for 1 year for those under the age of 18 at the time of the violation.
